Pre-Nuptial Mediation

The process of pre-nuptial mediation provides the couple with the opportunity to discuss and agree on how monies are handled long before there can be any issue.

This includes how a relationship can be affected by having separate accounts or joint accounts, how money is managed, spending habits, and credit issues, and differences in investing, risk tolerance, etc.

Are Pre-Nuptial Agreements A Good Thing Or A Bad Thing?

Benefits:

  • It helps to assure that you are both marrying for the right reason—for love!
  • It protects both parties in the event of death or divorce.
  • Advance planning prevents concerns about whether a Pre-Nuptial agreement was signed under duress.
  • Addresses age differences between the parties who are getting married.
  • Addresses concerns regarding second or third marriages and concerns about providing for spouses and/or children of prior marriages.

Disadvantages:

Bringing up the idea of a Pre-Nuptial agreement can cause uncomfortable feelings. This usually occurs when the person being asked to sign an agreement doesn’t understand the details or the benefits of a Pre-Nuptial Agreement.

Post-Nuptial Mediation

There is no legal separation in Florida, so implementing a Post-Nuptial Agreement is a way to provide some separation and independence for couples. There are a variety of reasons for couples choosing to do this.

In long term marriages, some couples feel like they may not remarry if there was a divorce and they don’t want to split up their assets. Sometimes there are health reasons for maintaining a legal marriage.

Essentially, the process provides the couple with the opportunity to discuss and agree how monies will be handled before there can be any issue. This includes how a relationship can be affected by having separate accounts or joint accounts, how money is managed, spending habits, and credit issues, and differences in investing, risk tolerance, etc.

Are Post-Nuptial Agreements A Good Thing Or A Bad Thing?

  • Addresses concerns regarding second or third marriages and concerns about providing for spouses, ex-spouses or children.
  • Clearly defines what would happen in the event of a possible dissolution of marriage or in the event of death of either person.

Disadvantages:
